Welcome to Payful (“we,” “us,” “our”).

These Terms and Conditions (“Terms”) govern your use of our mobile application (the “App”). Please read them carefully before using our services.

By using our App, you confirm that you have read, understood and agree to these Terms and all applicable UK laws. If you do not agree to these Terms, you must stop using the App.

  1. Definitions


    • “App”: The platform operated by Payful for enabling card and contactless payment processing.

    • “Services”: The features and functionalities provided through the App.

    • “User”: Any individual or business entity that registers for and uses the App.

    • “Third-Party Providers”: External services, including Stripe and Apple Tap to Pay, used to process payments.


  2. Eligibility and Registration

    To use the App, you must:

    • Be at least 18 years old and capable of entering binding legal agreements.

    • Be authorised to act on behalf of your business.

    • Comply with all applicable laws, including anti-money laundering (AML), Know Your Customer (KYC), and tax regulations.

    You must provide accurate, complete, and up-to-date information during registration. Failure to do so may result in suspension or termination of your account.

    You are responsible for maintaining the confidentiality of your login credentials and any activities under your account.

    Notify us immediately of any unauthorised access or security breaches.


  3. Use of the App

    You agree to use the App only for lawful purposes and in compliance with these Terms. Prohibited activities include:

    • Processing payments for illegal, fraudulent, or prohibited goods or services.

    • Violating AML or KYC requirements.

    • Tampering with, reverse-engineering, or otherwise interfering with the App’s functionality.

    You are responsible for ensuring all transactions comply with applicable laws, including the collection and remittance of taxes.


  4. Payment Processing

    Our App facilitates payment processing through Third-Party Providers. By using our App, you confirm that you have read, understood and agree to the respective terms listed below.

    We are not liable for delays, errors, or disputes arising from Third-Party Providers. Contact the respective provider for issues related to payment processing.


  5. Fees and Charges

    Fees for using the App include:

    • Transaction Fee: An amount deducted of from each processed payment.

    • Subscription Fees: If applicable, recurring charges for additional features.


    Users are responsible for fees from financial institutions or Third-Party Providers, including currency conversion or chargeback fees.
    We may change fees with 30 days prior notice. Updated fees will be communicated via email or the App.


  6. Refunds and Chargebacks

    Refunds and chargebacks are subject to the policies of Stripe. While Payful may share part of the facilitation of these processes, we are not responsible for decisions made by Third-Party Providers.

  7. Security and Data Protection

    We use industry-standard security measures to protect your data. However, no system is entirely secure, and you acknowledge that the use of the App is at your own risk.
    We may share transaction-related data with Third-Party Providers as necessary. By using the App, you consent to this data sharing.
    Your personal data is handled in accordance with the UK GDPR and our Privacy Policy.

    While we carefully select Third-Party Providers to ensure they meet industry security and compliance standards, we have no control over how these third parties use, process, or protect the data we share with them.

    By using the App, you acknowledge and agree that Payful is not responsible for the data processing practices of Third-Party Providers.

  8. Service Availability

    We aim to provide uninterrupted access to the App but do not guarantee availability. Scheduled maintenance, technical issues, or unforeseen events may result in temporary service disruptions.


  9. Intellectual Property

    All rights in the App, including its software, design, and branding, belong to Payful Platforms LTD or its licensors. You may not copy, distribute, or modify any part of the App without our permission.


  10. Termination

    We reserve the right to suspend or terminate your account at our discretion for reasons including, but not limited to, violation of these Terms and Conditions, illegal activity, or security concerns. You may also terminate your account at any time by contacting our support team.

    You may terminate your account at any time within the App using the Delete Account option in the settings, or you can contact our support team.


  11. Governing Law and Jurisdiction

    These Terms are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.


  12. Dispute resolution

    If a dispute cannot be resolved, both parties agree to mediation under the Centre for Effective Dispute Resolution (CEDR) rules before pursuing legal action.


  13. Changes to Terms

    We reserve the right to update or modify these Terms at any time. We will notify you of significant changes through email or within the app. Continued use of Payful after changes are made indicates your acceptance of the revised terms.
